As used in this article the following term has the following meaning: “Motorized Scooter” means every motor vehicle that is two- or three-wheeled device that has handlebars, is designed to be stood or sat upon by the operator, and is powered by an engine or electric motor that is capable of propelling the device with or without human propulsion, as follows:

If the power source is a combustion engine, such engine has a piston or rotor displacement of 35 cubic centimeters or less regardless, of the number of chambers in the power source; or If the power source is electric, such motor has a power output of not more than 1000 watts. The term “motorized scooter” shall not include motorized bicycles, motorcycles, motor-driven cycles, low-powered cycles, or motorized wheelchairs as defined in the Standard Traffic Ordinance.

Every person operating a motorized scooter shall do so only in compliance with the provisions of Sections 127 to 133, inclusive, of the Standard Traffic Ordinance as adopted by the governing body of the City, insofar as such provisions apply to such vehicles. Notwithstanding any other provision of law, motorized scooters shall not be operated on any property within the city that is clearly and visibly marked by a sign and signs indicating that motorized scooters are prohibited thereon. A sign or signs generally prohibiting operation of bicycles, skateboards or in-line skates shall automatically apply to motorized scooters. Placement of any such sign on privately-owned property shall constitute authorization for the police department to enforce the provision of this section upon such property.

No person under the age of 18 years shall operate or ride upon a motorized scooter upon public parking lots or public parking lots; unless wearing a safety helmet. No person shall operate a motorized scooter upon a public street or public parking lot in any contest of speed or exhibition of accelerations; No person shall operate a gasoline-powered motorized scooter upon a public street or public parking lot unless it has a functioning muffler complying with Section 175 of the Standard Traffic Ordinance as adopted by the governing body of the City.

Law enforcement officers are authorized to impound any motorized scooter that the officer determines to have been used in violation of this article. A motorized scooter impounded under this provision may only be released to the owner, or in the case of a violator who is under the age of 18 years of age, the parent or guardian of the violator, upon proof of ownership and payment of an impound administrative fee.

All motorized scooters shall be registered with the Galva Police Department within 30 days of the date of purchase or acquisition and display a valid registration decal affixed in a conspicuous place on the frame. Registration shall be accomplished on a form provided therefore by the Galva Police Department, which shall require such information as the Chief of Police deems appropriate to identify the vehicle so registered. The registration fee for a motorized scooter shall be as determined by the Galva City Council. Registration of motorized scooters shall be nontransferable.

It is unlawful for any person to violate any of the provisions of this article. Penalties and fines for violation shall be assessed in the manner set forth in Section 201 of the Standard Traffic Ordinance as adopted by the governing body of the City. Any police officer finding a minor under the age of 14 violating the provisions of this section shall issue a written warning to such minor and given written notice of this violation, setting forth the nature of the violation, to such minor’s parent or guardian. All persons who are above the age of 14 found to be in violation of this article shall be issued a notice to appear for the violation and it is to be filed in the municipal court of the City of Galva.
